Les Conditions de service (« Conditions ») constituent des accords ayant force obligatoire et qui régissent votre utilisation des Services de GameDuell et/ou les jeux et applications proposés par GameDuell GmbH (« GD ») et accessibles sur des sites Web tiers (collectivement appelés le « Service »). En accédant à ce Service et en l’utilisant, vous acceptez de vous conformer aux Conditions mentionnées ci-dessous.

Les utilisateurs sont tenus de consulter les présentes Conditions de service régulièrement. La version la plus récente des Conditions de service peut être consultée en cliquant sur le lien hypertexte « Conditions de Service » qui se trouve sur les sites de GameDuell. Si vous n’acceptez pas les Conditions de service suivantes ou toute modification ou mise à jour, vous pouvez supprimer votre compte ou vous désabonner des Services que vous avez souscrits. Si vous continuez d’utiliser les Services de GameDuell suite à un changement ou une mise à jour des Conditions de service, vous acceptez alors le changement ou la mise à jour en question et ce pendant au moins un mois après le dernier changement.

GameDuell se réserve le droit de changer ces Conditions à tout moment et de quelque manière que ce soit et de résilier votre accès au service sans préavis en cas violation des Conditions stipulées ci-après.

Compte

GameDuell se réserve le droit de refuser, à sa seule discrétion, à tout utilisateur l’accès aux Sites ou aux Services de GameDuell et ce sans préavis et avec ou sans motif (y compris, sans limitation, la violation des présentes Conditions de service).

Vous attestez que vous avez 18 ans ou plus.

Si un des Services nécessite l’ouverture d’un compte (Services sur abonnement), vous acceptez que toutes les informations que vous fournissez pendant le processus d’enregistrement sont véridiques et exactes (y compris, sans limitation, vos données de facturation comme le numéro de carte bancaire et la date d’expiration), et vous acceptez de payer tous frais d’abonnement engagés ainsi que les taxes applicables. Il vous sera demandé de choisir un mot de passe et un nom d’utilisateur/compte.

Vous ne pouvez utiliser un nom d’utilisateur/compte qui est déjà attribué, qui est vulgaire ou autrement offensant (définis par GameDuell), qui enfreigne une marque déposée ou tout autre droit de propriété de tiers ou qui représente de quelque manière que ce soit une violation des Conditions de service.

Il est de votre entière responsabilité de protéger la confidentialité de votre mot de passe et de votre compte. En outre, vous êtes entièrement responsable de l’ensemble des activités effectuées sur votre compte. Vous acceptez d’avertir GameDuell immédiatement en cas d’utilisation non autorisée ou de piratage de votre compte ou de toute autre violation à la sécurité (et de fournir les preuves demandées par GameDuell).

Nous ne serons pas responsables des pertes causées par quelqu’un d’autre utilisant votre mot de passe ou compte, avec ou sans votre consentement. Toutefois, vous serez responsable des pertes subies par GameDuell ou des tiers et causées par quelqu’un d’autre utilisant votre compte ou mot de passe. Vous ne pouvez à aucun moment utiliser le compte d’un autre utilisateur.

Lorsque les Services utilisent la gestion des comptes d’un site Web hébergeant un réseau social (tel que Facebook), vous êtes responsable de la confidentialité de votre mot de passe et de votre compte de ce réseau social, et vous détenez l’entière responsabilité pour toutes les activités effectuées sur ce compte. GameDuell ne sera pas responsable du piratage ou de la perte d’objets virtuels issus des jeux de votre compte GameDuell, nous nous engageons cependant à déployer les efforts raisonnables pour remplacer ces objets, dans certaines circonstances, et à notre seule et unique discrétion. Nous n’avons aucune obligation ou responsabilité envers vous et ne vous rembourserons pas les objets virtuels perdus issus des jeux si vous avez violé les présentes Conditions de service. GameDuell se réserve le droit, sans préavis, de limiter la quantité d’achats des objets virtuels issus des jeux et/ou de refuser de vous les fournir. La vérification de certaines informations relatives à une transaction concernant un objet virtuel peut être nécessaire avant notre acceptation de cette dernière. Le prix et la disponibilité des objets virtuels peuvent être modifiés sans préavis.

Monnaies virtuelles en jeu

Le Service peut comporter plusieurs monnaies virtuelles en jeu (« Monnaie virtuelle ») y compris, sans limitation, des « pièces », des « espèces » (par exemple « jungle cash »), que vous pouvez acheter à GameDuell pour de l’argent « réel » si vous avez l’âge minimum requis dans votre pays de résidence. Le Service peut aussi comporter des objets virtuels digitaux en jeu (« Biens virtuels ») qui peuvent être achetés à GameDuell avec de l’argent « réel » ou une Monnaie virtuelle.

Quelle que soit la terminologie, la Monnaie virtuelle et les Biens virtuels ne pourront être rachetés à GameDuell ou des tiers contre de l’argent du « monde réel », des biens ou d’autres objets de valeur monétaire. GameDuell se réserve le droit de changer la monnaie virtuelle contre des objets virtuels ou des fonctions de jeu à tout moment. La valeur de la Monnaie virtuelle et les taux de change virtuels sont susceptibles d’être changés par GameDuell à tout moment et de quelque manière que ce soit. En utilisant la Monnaie virtuelle vous acceptez la valeur en cours de ladite Monnaie virtuelle.

La Monnaie virtuelle et les biens sont NON REMBOURSABLES et NON TRANSFÉRABLES :

VOTRE ACHAT DE PIÈCES OU DE TOUTE AUTRE MONNAIE EN LIGNE EST DÉFINITIF ET NE SERA EN AUCUN CAS REMBOURSÉ, TRANSFÉRÉ OU ÉCHANGÉ Y COMPRIS, SANS LIMITATION, LORS DE LA SUPPRESSION DE VOTRE COMPTE SUR GAMEDUELL POUR QUELQUE RAISON QUE CE SOIT, LA RÉSILIATION DU PRÉSENT ACCORD, ET/OU LA CESSATION DES SERVICES. INDÉPENDAMMENT DE LA CONTREPARTIE OFFERTE OU ACHETÉE EN ÉCHANGE D’OBJETS VIRTUELS ISSUS DES JEUX, VOUS N’EN DÉTENEZ PAS LES DROITS DE PROPRIÉTÉ.

Les transferts de Monnaies virtuelles et de Biens virtuels sont strictement interdits, sauf explicitement autorisés au sein du Service. En dehors du jeu, vous ne pouvez acheter et vendre la Monnaie virtuelle ou les Biens virtuels contre de l’argent du « monde réel » ou échanger des objets de quelque manière que ce soit contre de l’argent. Toute tentative à cet égard constitue une violation des Conditions et peut donner lieu à une interdiction à vie du Service de GameDuell et peut engager d’éventuelles poursuites en justice.

Vous acceptez le caractère définitif des ventes de Biens virtuels et de Monnaies. Aucun remboursement ne sera effectué, sauf à notre seule et entière discrétion. Tout Bien virtuel et toute Monnaie sont perdus lors de la résiliation ou de la suspension de votre compte pour quelque motif que ce soit, à la seule et entière discrétion de GameDuell ou si GameDuell cesse de fournir le Service.

GameDuell a le droit absolu de gérer, réguler, contrôler, modifier et/ou éliminer une telle Monnaie virtuelle et/ou des Biens virtuels comme il le juge approprié et à son entière discrétion, et n’a aucune responsabilité envers vous ou toute autre personne dans l’exercice de ces droits.

GameDuell peut appliquer des frais d’abonnement pour accéder à certains Services (y compris à certains jeux) et participer aux activités connexes.

Paiement

Afin d’effectuer les paiements, nous travaillons avec des tiers qui pourraient fournir des liens à d’autres sites Web vous proposant des offres et certains services gratuitement.

L’utilisation des modes de paiement tels que, sans limitation, PayPal, Boku, Paysafe etc. est à vos propres risques.

GameDuell n’est affilié à aucune des Marques extérieures et n’est pas responsable des éventuels dommages causés par les Modes de paiement et l’indication de données personnelles telles que le numéro de téléphone portable etc.

Vous êtes responsable d'acquitter tous les frais encourus ou d'endosser toutes les obligations que vous avez prises dans le cadre d'une opération avec ces tiers.

GameDuell ne fait aucune déclaration et ne donne aucune garantie concernant le processus/fournisseur de paiement, le contenu, les biens, et les services fournis par des tiers.

Contenu généré par les utilisateurs

Les Services peuvent contenir des services de messagerie électronique, des zones de discussion, des groupes de discussion, des forums, des communautés, des albums photo, des dossiers d’archivage et/ou d’autres messageries ou moyens de communication conçus pour communiquer avec autrui (les « Services de communication »). Vous acceptez d’utiliser les Services de communication uniquement pour afficher, envoyer et recevoir des messages et des contenus qui sont appropriés pour le service de communication utilisé et, le cas échéant, qui y sont reliés. GameDuell n’a aucune obligation de surveiller les Services de communication. GameDuell se réserve le droit d’examiner les éléments publiés sur les Services de communication et de retirer les contenus à tout moment, sans préavis et pour quelque raison que ce soit à sa seule discrétion. GameDuell se réserve le droit de refuser ou de suspendre votre accès à l’ensemble des Services de communication à tout moment, sans préavis et pour quelque raison que ce soit. Vous reconnaissez que les discussions, les affichages, les conférences et autres communications d'utilisateurs ne relèvent pas de la responsabilité de GameDuell, et de telles communications ne doivent pas être considérées comme revues, filtrées ou approuvées par GameDuell. Les déclarations faites dans les forums, les conférences, les panneaux d’affichage et les discussions ne reflètent que le point de vue de leur auteur. GameDuell rejette expressément toute responsabilité concernant les Services de communication et les poursuites éventuelles découlant de votre participation à un service de communication. Les administrateurs et hôtes ne sont pas des représentants agréés de GameDuell et leurs opinions ne reflètent pas nécessairement celles de GameDuell.

Vous reconnaissez et acceptez que vos communications avec d’autres utilisateurs à travers les Services de communication soient des communications publiques et non privées et que vous n’avez aucune attente en matière de vie privée en utilisant ces Services de communication. Vous reconnaissez que toute information personnelle que vous communiquez sur les Services de communications est susceptible d’être consultée et utilisée par d’autres utilisateurs et peut aboutir à des communications non sollicitées ; pour cette raison, nous vous recommandons fortement de ne pas divulguer d’informations personnelles dans les communications publiques de nos Services. GameDuell n’est ni responsable du type d’information que vous souhaitez communiquer à d’autres utilisateurs à travers les Services de communication, ni des actes d'autres utilisateurs.

GameDuell se réserve le droit, en tout temps, de divulguer toute information ou contenu nécessaire pour se conformer aux exigences de la loi, des règlements, une action en justice ou à la demande du gouvernement ou pour modifier, refuser d’ envoyer ou retirer, totalement ou partiellement, toute information ou contenu à la seule discrétion de GameDuell. Pour faire suite à ce qui précède et à titre d’exemple, sans limitation, vous acceptez de ne pas pouvoir accéder et utiliser les Services et/ou les Services de communication pour :

• Utiliser ces Services dans le cadre de sondages, concours, systèmes pyramidaux, chaînes, pourriels, spamming, ou de tout message massif ou non sollicité (à cadre commercial ou autre).
• Diffamer, agresser, harceler, traquer, menacer, ou violer de quelque manière que ce soit les droits d'autrui (tels que, par exemple, les droits relatifs à la vie privée ou à la publication).
• Publier, afficher, charger, envoyer, distribuer ou diffuser tout Contenu blessant, injurieux, vulgaire, sexuellement explicite, diffamatoire, calomnieux, obscène, envahissant, indécent, non désiré, enfreignant le droit à la vie privée ou à la publicité de tiers, haineux ou répréhensible sur le plan racial, ethnique ou autre
• Utiliser, charger, transmettre, distribuer ou rendre disponible de quelque manière que ce soit tout contenu ou information, y compris les images et photos, qui sont mises à disposition à travers ces Services d'une manière qui porte atteinte à un droit d'auteur, à une marque de commerce, à un brevet, à un secret commercial ou à d'autres droits exclusifs de quiconque (y compris les droits à la vie privée et à la publicité).
• Charger des fichiers contenants des virus, Chevaux de Troie, vers informatiques, bombes logicielles, robots d'annulation, fichiers ou données corrompus ou autres logiciels ou programmes similaires qui peuvent endommager le fonctionnement des Services ou l’ordinateur d’un autre utilisateur.
• Sauf en cas d’autorisation expresse par GameDuell, faire la publicité pour la vente ou proposer à la vente tous produits ou services à toutes fins commerciales, à moins que les Services ne permettent de tels messages explicitement.
• Falsifier, supprimer ou désactiver toutes informations relatives aux droits d'auteur comme les attributions d’auteur, les informations légales et autres notifications, les appellations ou labels d'origine ou de provenance du logiciel ou autres éléments contenus dans un fichier qui a été téléchargé.
• Empêcher ou interdire à tout autre utilisateur d'utiliser ou de profiter des Services. Par exemple, interrompre les flux de discussion par des propos vulgaires ou injurieux, en appuyant de manière répétée sur la touche Entrée, en insérant des images volumineuses de manière à faire défiler l'écran trop rapidement pour qu’il soit possible de le lire, en utilisant de manière excessive les majuscules dans le but de gêner les autres utilisateurs ou en ayant recours au « spamming » (arrosage) ou flooding (saturation) [envoi répété de textes].
• Recueillir des informations personnelles sur les autres utilisateurs, y compris des adresses électroniques ou utiliser ces informations pour envoyer des courriels non sollicités.
• Enfreindre la loi ou la réglementation en vigueur ou promouvoir ou encourager une activité illégale, notamment, sans limitation, le piratage, le craquage ou la diffusion de logiciels contrefaits ou la fraude ou le piratage des Services ou du Logiciel.
• Imiter ou créer une fausse identité (par exemple une célébrité ou un représentant de GameDuell) dans le but de tromper des tiers.
• Utiliser, télécharger, copier ou fournir (gratuitement ou non) à une personne ou une entité, un répertoire d’utilisateurs de ces Services, d'autres renseignements sur les utilisateurs ou des données, en tout ou en partie, sur l'utilisation des Services.
• Tenter d'obtenir un mot de passe, des renseignements personnels ou des informations liées au compte d'un membre ou de tout autre utilisateur des Services.
• Faire un usage inapproprié du service d'assistance aux jeux ou des boutons de réclamation ou envoyer des rapports mensongers aux administrateurs de GameDuell.
• Utiliser, développer ou diffuser des programmes informatiques « auto », « macro » ou d’autres programmes ou applications de triche qui enfreignent le contrat de licence applicable.
• Utiliser un tableau d’affichage ou tout autre Service de communication à toute autre fin que la communication personnelle en tant qu’utilisateur individuel (par exemple non pas en tant que société ou tout autre entité).
• Utiliser les sites, les Services et le Logiciel de GameDuell pour la revente ou toute autre utilisation commerciale des Sites, des Services et du Logiciel de GameDuell ou toute autre exploitation commerciale sans consentement exprès préalable par écrit de GameDuell.
• Utiliser les Services pour des transactions frauduleuses y compris, sans limitation, des transactions virtuelles dans les jeux.
• Vendre, acheter ou transférer l’accès à votre compte.
• Vous n’exploiterez, ne distribuerez et ne communiquerez pas publiquement toute erreur de jeu, panne ou bogue qui donne un avantage involontaire.

GameDuell et ses représentants désignés ont le droit et non pas l’obligation, à leur seule discrétion, de modifier, de refuser d’afficher ou de retirer tout Contenu affiché sur les Sites de GameDuell. Sans limiter ce qui précède, GameDuell et ses représentants désignés ont le droit de retirer tout Contenu qui enfreint les dispositions de la présente ou qui est jugé inacceptable.

Droit d’auteur

Les Services comprennent, sans limitation, tout Logiciel, Jeu, Logo, Graphisme, Animation, Personnage, Musique et tout autre Contenu, et contiennent des documents protégés par un droit d’auteur, des marques déposées et autres renseignements exclusifs (y compris, sans limitation, des images, photos, animations, vidéos, fichiers audio, musique, fichiers texte et « applets » incorporés au Logiciel et aux données de caractère).

L’ensemble du contenu du Service et chacun de ses domaines est protégé par un droit d’auteur en tant que travail collectif aux termes des lois de la République fédérale d’Allemagne. GameDuell possède le droit d’auteur dans la sélection, la coordination, l’arrangement et la valorisation du Contenu. Vous reconnaissez que GameDuell, et/ou ses concédants restent les propriétaires de tous les droits, titres et intérêts, y compris les droits d’auteur et les autres droits de propriété intellectuelle des contenus affichés sur les Services par GameDuell ainsi que des dérivés, et que l’utilisateur n’acquiert aucun de ces droits par l’accès à ces contenus.

Vous n’acquérez aucun droit de propriété en utilisant ce Service, en téléchargeant son contenu ou en téléchargeant le vôtre sur le Service ou en achetant des Biens virtuels et vous acceptez de ne pas copier, redistribuer, publier ou exploiter de quelque manière que ce soit le contenu provenant du Service, sauf autorisation expresse dans la présente, sans l’autorisation expresse préalable par écrit de GameDuell.

Tout retour des utilisateurs, commentaire, idée, et autres suggestions (« Idées ») divulgués, indiqués ou proposés à GameDuell dans le cadre de l’utilisation du Service sont la propriété exclusive de GameDuell. Vous acceptez que, à moins que la loi ne l’interdise, GameDuell peut utiliser, vendre, exploiter et divulguer les Idées de quelque manière que ce soit, sans restriction et sans rémunération envers vous.

Résiliation du compte

GameDuell a le droit de résilier ou de suspendre, et vous avez le droit de supprimer, votre/vos compte(s) ou un abonnement spécifique à tout moment. Vous comprenez et reconnaissez que, sauf disposition contraire prévue par la loi, la suppression de votre compte ou l’annulation d’un abonnement spécifique est votre plein droit et recours à tout litige avec GameDuell. Ceci comprend, sans limitation, tout litige concernant ou résultant de : (1) les présentes Conditions de service ou notre exécution ou application de ces dernières ; (2) le Contenu ou les Services mis à disposition à travers les Sites de GameDuell ou tout changement de ce Contenu ; (3) votre capacité à accéder et/ou utiliser les Services ; ou (4) le montant ou le type de frais, suppléments, taxes applicables, méthodes de facturation ou tout changement de ces frais, taxes applicables, suppléments ou méthodes de facturation.

Vous pouvez supprimer votre/vos compte(s) ou un abonnement spécifique pour un Service en suivant les procédures mises à disposition pour le Service concerné. GameDuell se réserve le droit de percevoir des droits, suppléments ou coûts encourus avant que vous ne puissiez supprimer votre/vos compte(s) ou un abonnement spécifique. Si votre compte ou un abonnement spécifique est résilié, suspendu ou supprimé, aucun remboursement ne sera fait ; aucun temps en ligne ou autres crédits ou objets issus des jeux (par exemple les points dans un jeu en ligne) vous seront crédités ou convertis en espèces ou toute forme de remboursement, et vous n’aurez plus accès à votre compte ou toute chose associée à celui-ci (comme des points, jetons ou objets issus des jeux). Si votre compte est résilié ou suspendu par GameDuell, GameDuell a le droit de résilier ou de suspendre le(s) autre(s) compte(s) que vous détenez.

DANS UN SOUCI DE CLARTÉ, LA SUSPENSION OU LA RÉSILIATION DE VOTRE/VOS COMPTE(S) OU ABONNEMENT(S) DE GAMEDUELL N’AURA AUCUN IMPACT SUR VOTRE/VOS COMPTE(S) DE RÉSEAUX SOCIAUX.

Exclusion de garantie et limitation de responsabilité

Vous reconnaissez expressément que l’utilisation du Service et surtout du système de paiement sont à vos seuls risques. Ni GameDuell ni l’ensemble de ses dirigeants, administrateurs, employés, agents, marchands, sponsors, concédants, fournisseurs de composants (matériels et logiciels), et/ou des tiers qui fournissent des produits ou services achetés à ou distribués par GameDuell (collectivement appelés « Fournisseurs ») ou autres, garantissent que les sites Web associés aux Fournisseurs, y compris mais sans limitation, à ce Service, seront sans interruption, sans erreur, libres de virus, vers, chevaux de Troie, intercepteurs de frappe, logiciels espion, logiciels publicitaires, logiciels malveillants, codes malveillants et nuisibles ou tout autre défaut. Les informations, produits et services publiés sur le site Web peuvent contenir des inexactitudes ou des erreurs typographiques. GameDuell ne donne aucune garantie concernant les résultats qui peuvent découler de l’utilisation du site Web ou concernant l’exactitude, la fiabilité ou l’actualité du contenu, du service ou de la marchandise fournis à travers le site Web. En outre, GameDuell décline toute responsabilité par rapport à toute opinion, point de vue, conseil ou déclaration affichés sur le Service (y compris, sans limitation, dans tous les domaines d’affichage publics du Service) par toute personne ou entité autre que le représentant autorisé de GameDuell. CE SERVICE, Y COMPRIS LE SERVICE ET LE LOGICIEL, EST FOURNIS PAR GAMEDUELL « TEL QUEL » ET « SUIVANT DISPONIBILITÉ ». DANS TOUTE LA MESURE AUTORISÉE PAR LA LOI EN VIGUEUR ; GAMEDUELL ET LES FOURNISSEURS DÉCLINENT TOUTE GARANTIE IMPLICITE, Y COMPRIS, SANS LIMITATION, LES GARANTIES IMPLICITES ET STATUTAIRES DE QUALITÉ MARCHANDE, L’ADAPTATION À UNE FIN PARTICULIÈRE, ET LE RESPECT DES DROITS DE PROPRIÉTÉ.

GAMEDUELL ET LES FOURNISSEURS NE FONT AUCUNE DÉCLARATION OU GARANTIE DE QUELQUE SORTE QUE CE SOIT, EXPRESSE OU IMPLICITE, CONCERNANT LE FONCTIONNEMENT DU SITE WEB, LA SÉCURITÉ DU SITE WEB, LA DISPONIBILITÉ DE BIENS OU DE SERVICES PROPOSÉS SUR OU AU TRAVERS LE SITE WEB, Y COMPRIS LES MESSAGES ÉLECTRONIQUES OU LES INFORMATIONS, LE CONTENU, LE MATÉRIEL OU LES PRODUITS COMPRIS SUR CE SITE WEB. TOUT SERVICE OU LOGICIEL TÉLÉCHARGÉ OU OBTENU AUTREMENT EN UTILISANT CE SITE WEB EST À VOTRE SEULE DISCRÉTION ET À VOS PROPRES RISQUES ET VOUS SEUL DETENEZ L’ENTIÈRE RESPONSABILITÉ POUR TOUT DOMMAGE DE VOTRE SYSTÈME INFORMATIQUE OU TOUTE PERTE DE DONNÉES CAUSÉE PAR LE TÉLÉCHARGEMENT ET/L’INSTALLATION D’UN TEL MATÉRIEL. CERTAINS ÉTATS OU AUTRES JURIDICTIONS NE PERMETTENT PAS L’EXCLUSION DES GARANTIES IMPLICITES, DONC LES EXCLUSIONS CI-DESSUS NE S’APPLIQUENT PEUT-ÊTRE PAS À VOUS.

UN FAIBLE POURCENTAGE D’UTILISATEURS RENCONTRERA ÉVENTUELLEMENT DES CRISES ÉPILEPTIQUES LORS DE L’EXPOSITION À CERTAINES CONFIGURATIONS DE LUMIÈRE, UN FOND D’ÉCRAN OU PENDANT L’UTILISATION DU SERVICE. CERTAINES CONDITIONS PEUVENT PROVOQUER DES SYMPTOMES D’UNE ÉPILEPSIE NON DÉTECTÉS AUPARAVANT, MÊME LES UTILISATEURS QUI N’ONT AUCUN ANTÉCÉDENT DE CRISES ÉPILEPTIQUES. SI VOUS OU TOUT AUTRE MEMBRE DE VOTRE FAMILLE SOUFFREZ D’ÉPILEPSIE, VOUS DEVEZ CONSULTER VOTRE MÉDECIN AVANT D’UTILISER LE SERVICE. This Terms of Service ("Terms") are a legally binding agreement that governs your use of GameDuell Services and/or the games and applications offered by GameDuell GmbH ("GD") and accessed through third party web sites (collectively, the "Service"). Account

GameDuell reserves the right to deny, in its sole discretion, any user access to the GameDuell Sites or Services without notice for any or no reason (including, without limitation, for violation of these Terms of Service).
You represent that you are 13 years old or older. Additionally, if you are between the ages of 13 and 18, you represent that your legal guardian has reviewed and agrees to the Terms.

If any of the Services require you to open an account (subscription-based Services) you agree that all information that you submit during the registration process is true and accurate (including, without limitation, your billing information such as credit card number and expiration date), and you agree to pay all subscription fees you incur plus all applicable taxes. You agree to notify GameDuell immediately of any unauthorized use or theft of your account or any other breach of security (and to provide properly documented evidence as reasonably requested by GameDuell). We will not be liable for any loss that you may incur as a result of someone else using your password or account, either with or without your knowledge. However, you will be liable for losses incurred by GameDuell or another party due to someone else using your account or password. You may not use anyone else's account at any time.

Where the Services utilize the account management of a social networking website (such as Facebook), you are responsible for maintaining the confidentiality of your applicable social networking website password and account, and are fully responsible for all activities that occur under your account. GameDuell shall have no liability for hacking or loss of virtual in-game items from your GameDuell Account, provided we will use reasonable efforts to replace such items under certain circumstances in our reasonable discretion. We have no obligation or responsibility to and will not reimburse you for any virtual in-game items lost due to your violations of these Terms of Service. GameDuell reserves the right, without prior notification, to limit the order quantity on any virtual in-game item and/or to refuse to provide you with any virtual in-game item. Verification of certain information applicable to a transaction involving a virtual in-game item may be required prior to our acceptance thereof. Price and availability of the virtual in-game items are subject to change without notice.

Virtual In Game Currencies

The Service may include various virtual, in-game currencies ("Virtual Currency") including, but not limited to "coins", "cash" (f.e. "jungle cash"), that may be purchased from GameDuell for "real" money if you are a legal adult in your country of residence. The Service may also include virtual, in-game digital items ("Virtual Goods") that may be purchased from GameDuell for "real" money or for Virtual Currency. Regardless of the terminology used, Virtual Currency and Virtual Goods may never be redeemed for "real world" money, goods or other items of monetary value from GameDuell or any other party. GameDuell reserves the right to change the virtual currency for virtual items or game features at any time. The value of the virtual Currency and the virtual changing rates can be changed by GameDuell in every way and at any time. By using the virtual Currency you accept the current value of the virtual Currency.

Virtual Currency and goods are NON REFUNDABLE and NON TRANSFERABLE:

YOUR PURCHASE OF COINS OR OTHER ONLINE CURRENCY IS FINAL AND SHALL UNDER NO CIRCUMSTANCES BE REFUNDABLE, TRANSFERABLE OR EXCHANGEABLE INCLUDING, WITHOUT LIMITATION, UPON TERMINATION OF YOUR GAMEDUELL ACCOUNT FOR ANY REASON, TERMINATION OF THIS AGREEMENT, AND/OR THE DISCONTINUATION OF THE SERVICES. REGARDLESS OF THE CONSIDERATION OFFERED OR PAID IN EXCHANGE FOR VIRTUAL IN-GAME ITEMS, YOU DO NOT HAVE ANY OWNERSHIP RIGHTS IN THE VIRTUAL IN-GAME ITEMS.

Transfers of Virtual Currencies and Virtual Goods are strictly prohibited except where explicitly authorized within the Service. Outside of the game, you may not buy or sell any Virtual Currency or Virtual Goods for "real world" money or otherwise exchange items for value. Any attempt to do so is in violation of these Terms and may result in a lifetime ban from GameDuell Service and possible legal action.

You agree that all sales of Virtual Goods and Currencies are final. No refunds will be given, except in our sole and absolute discretion. All Virtual Goods and Currencies are forfeited if your account is terminated or suspended for any reason, in GameDuell's sole and absolute discretion, or if GameDuell discontinues providing the Service.

GameDuell has the absolute right to manage, regulate, control, modify and/or eliminate such Virtual Currency and/or Virtual Goods as it sees fit in its sole discretion, and shall have no liability to you or anyone for the exercise of such rights.

GameDuell may charge subscription fees to access certain Services (including certain games) and participate in related activities.

Payment

We are working with third parties for the payment which may provide links to other websites where you can try offers and receive certain services for free.

The use of the payment methods such as, but not limited to Paypal, Boku, Paysafe etc. is at your own risk.
GameDuell is not affiliated to any of the Third Party Brands and not responsible for any damages due to the use of the Payment Methods and the submission of personal data like mobile number etc.
Any separate charges or obligations you incur in your dealings with these third parties are your own responsibility.

User generated Content

The Services may contain e-mail services, chat areas, news groups, forums, communities, photo albums, file cabinets and/or other message or communication facilities designed to enable you to communicate with others (the "Communication Services"). You agree to use the Communication Services only to post, send and receive messages and material that are proper and, when applicable, related to the particular Communication Service. GameDuell has no obligation to monitor the Communication Services.
GameDuell reserves the right to review materials posted to the Communication Services and to remove any materials at any time, without notice, for any reason and in its sole discretion. GameDuell reserves the right to terminate or suspend your access to any or all of the Communication Services at any time, without notice, for any reason whatsoever. You acknowledge that chats, postings, conferences and other communications by users are not controlled or endorsed by GameDuell, and such communications shall not be considered reviewed, screened or approved by GameDuell. Statements made in forums, conferences, bulletin boards and chats reflect only the views of their authors. • Improperly use in-game support or complaint buttons or make false reports to GameDuell administrators.
• Use, develop or distribute "auto" software programs, "macro" software programs or other "cheat utility" software program or applications in violation of the applicable License Agreements.
• Use a bulletin board or other Communications Service in any manner other than for personal communication as an individual user (i.e. not as a corporation or other entity).
• Use the GameDuell Sites, Services or Software to resell or make any commercial use of the GameDuell Sites, Services or Software, or otherwise commercially exploit the same, without the prior express written consent of GameDuell.
• Use the Services for fraudulent transactions including, without limitation, in-game virtual transactions.
• Sell, buy, or transfer access to your account.
• You will not exploit, distribute or publicly communicate any game error, miscue or bug which gives an unintended advantage.

GameDuell and its designees shall have the right, but not the obligation, in their sole discretion to edit, refuse to post, or remove any Content posted in any GameDuell Site. Without limiting the foregoing, GameDuell and its designees shall have the right to remove any Content that is in violation of the provisions hereof or otherwise objectionable.

The Services including, without limitation, all Software, Games, Logos, Grafics, Animations, Characters, Music and other Content, contains copyrighted material, trademarks and other proprietary information (including, without limitation, images, photographs, animations, video, audio, music, text, and "applets" incorporated into the Software and character data).

GameDuell owns a copyright in the selection, coordination, arrangement and enhancement of such Content. You acknowledge that GameDuell, and/or its licensors remain the owners of all right, title, and interest, including copyrights and other intellectual property rights, in and to all materials posted on the Services by GameDuell and derivative works thereof, and that you do not acquire any of those ownership rights by accessing such materials.

You do not acquire any ownership rights by using the Service, downloading material from or uploading material to the Service, or by purchasing any virtual Goods and agree not to copy, redistribute, publish or otherwise exploit material from the Service, except as expressly permitted herein, without the express prior written permission of GameDuell.

All User feedback, comments, ideas, and other submissions ("Ideas") disclosed, submitted, or offered to GameDuell in connection with the use of the Service shall be the exclusive property of GameDuell. You agree that unless otherwise prohibited by law GameDuell may use, sell, exploit and disclose the Ideas in any manner, without restriction and without compensation to you.

Termination of Account

GameDuell has the right to terminate or suspend, and you have the right to cancel, your account(s) or a particular subscription at any time. You understand and agree that, except as expressly provided by law, the cancellation of your account or a particular subscription is your sole right and remedy with respect to any dispute with GameDuell. This includes, but is not limited to, any dispute related to, or arising out of: (1) these Terms of Service or our enforcement or application of these Terms of Service; (2) the Content or Services available through the GameDuell Sites or any change in such Content; (3) your ability to access and/or use the Services; or (4) the amount or type of fees, surcharges, applicable taxes, billing methods, or any change to the fees, applicable taxes, surcharges or billing methods.

You can cancel your account(s) or a particular subscription for a Service by following the procedures made available with the applicable Service. GameDuell reserves the right to collect fees, surcharges or costs incurred before you cancel your account(s) or a particular subscription. In the event that your account or a particular subscription is terminated, suspended or canceled, no refund will be granted; no online time or other credits or in-game items (e.g., points in an online game) will be credited to you or converted to cash or other form of reimbursement, and you will have no further access to your account or anything associated with it (such as points, tokens or in-game items). If your account is terminated or suspended by GameDuell, GameDuell shall have the right to terminate or suspend any of your other account(s).

FOR THE PURPOSES OF CLARITY, SUSPENSION OR TERMINATION OF YOUR GAMEDUELL ACCOUNT(S) OR SUBSCRIPTION(S) SHALL NOT AFFECT YOUR SOCIAL NETWORKING WEBSITE ACCOUNT(S).

Disclaimer of Warranties and Limitation of Liability

You expressly agree that use of the Service and especially of the payment system is at Your sole risk.
